Terms of Service

1. Acceptance of Terms

By accessing or using CRELYTIC iQ Intel ("iQ Intel," the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, you may not access or use the Service. By creating an account or using an API key, you represent that you have authority to enter into these Terms on behalf of yourself or the organization you represent.

2. Description of Service

iQ Intel is a commercial real estate intelligence platform operated by CRELYTIC. iQ Intel offers subscription products built on aggregated, de-identified research output originally produced through the TenantIQ platform, including:

  • Tenant Risk Index (TRI): quarterly industry benchmark percentiles delivered as PDF and CSV.
  • Market Demand Heat Map: city- and state-level research demand signals delivered via weekly email digest and in-app views.
  • Credit Drift Alerts: watchlist-based email notifications when a tracked entity's composite score crosses user-defined thresholds.
  • Company Intelligence API: a REST API that returns the latest composite score, dimension breakdowns, and industry peer benchmarks for commercial entities.

iQ Intel outputs are derived from research generated using artificial intelligence (including large language models operated by Anthropic) applied to publicly available sources. They are provided for informational purposes only.

3. Account Registration

To use iQ Intel you must register for an account and provide accurate, complete, and current information. You are responsible for maintaining the confidentiality of your account credentials and API keys and for all activity that occurs under them. Notify us immediately of any unauthorized use. CRELYTIC reserves the right to suspend or terminate accounts that contain inaccurate information or that violate these Terms.

4. Subscription and Billing

Paid subscriptions are billed on a recurring basis through Stripe at the cadence selected at checkout. Subscriptions automatically renew at the end of each billing period unless canceled. If you cancel, you retain access to paid features through the end of the current billing period. No refunds are provided for partial billing periods except where required by applicable law. CRELYTIC may change pricing for future billing periods with at least 30 days' notice.

5. Acceptable Use

You agree not to use iQ Intel to:

  • Make discriminatory housing, leasing, employment, credit, or insurance decisions based on protected characteristics, including race, color, religion, sex, national origin, disability, or familial status.
  • Make any decision about an individual consumer's eligibility for credit, insurance, employment, housing, or other FCRA-regulated purpose (see Section 9).
  • Misrepresent iQ Intel outputs as legal advice, financial advice, credit reports, or professional opinions.
  • Resell, redistribute, or publicly publish iQ Intel outputs except as expressly permitted by your Customer Use License (Section 11) or a separate written agreement.
  • Forward, rebroadcast, or publicly display Credit Drift Alerts in a manner that identifies the monitored entity to the public or to the monitored entity itself, or that would be reasonably likely to defame or tortiously interfere with the monitored entity's business relationships.
  • Use iQ Intel outputs to train any competing machine-learning model, scoring system, or derivative data product.
  • Scrape, crawl, or otherwise programmatically extract data from the iQ Intel web application. Programmatic access is available only via the Company Intelligence API under the terms of Section 6.
  • Violate any applicable local, state, national, or international law or regulation, or infringe any third-party rights.
  • Attempt to reverse-engineer, decompile, or disassemble any portion of the Service, or transmit malicious code through the Service.

6. Company Intelligence API

Use of the Company Intelligence API is subject to these additional terms, which control to the extent of any conflict with the rest of these Terms:

  • Keys and authentication: API keys are issued to a specific organization and may not be shared, resold, or used to serve API traffic on behalf of any third party that has not separately agreed to these Terms.
  • Rate limits: you must respect rate limits and other usage controls communicated through the API or the developer documentation. CRELYTIC may throttle, suspend, or terminate keys that exceed reasonable usage or that exhibit abusive patterns.
  • Caching: you may cache API responses for up to 24 hours solely to reduce duplicate calls within your own application. You may not persist API responses to build an independent score database or scoring product.
  • Attribution:when scores or benchmark figures derived from the API are surfaced to end users, you must attribute the source as "CRELYTIC iQ Intel" in a reasonably visible manner.
  • No competing products: you may not use API responses to build, train, or operate a commercial real estate tenant risk scoring, credit drift, or market demand product that competes with iQ Intel.
  • Monitoring: we log API key, endpoint, timestamp, status, and aggregate usage for security, abuse prevention, and billing. See the Privacy Policy, Section 7.

7. Disclaimer of Warranties

iQ Intel outputs — including scores, benchmarks, alerts, heat maps, and API responses — are generated in part by artificial intelligence systems applied to publicly available sources. They are provided for informational purposes only and may contain inaccuracies, omissions, or out-of-date information. They are not a substitute for professional due diligence, credit analysis, legal advice, financial advice, or an underwriter's independent judgment. CRELYTIC does not guarantee the accuracy, completeness, or timeliness of any output. The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

8. Limitation of Liability

To the maximum extent permitted by applicable law, CRELYTIC, its affiliates, officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, goodwill, or other intangible losses resulting from your use of or inability to use the Service. In no event shall CRELYTIC's total liability exceed the amount paid by you to CRELYTIC for iQ Intel during the twelve months preceding the event giving rise to the claim.

9. FCRA Disclaimer

iQ Intel is not a consumer reporting agency as defined by the Fair Credit Reporting Act, 15 U.S.C. § 1681 et seq. ("FCRA"), and iQ Intel outputs — including Tenant Risk Index figures, Credit Drift Alerts, Market Demand Heat Map data, and API responses — do not constitute "consumer reports" under the FCRA. You may not use iQ Intel outputs as a factor in determining any individual's eligibility for credit, insurance, employment, housing, or any other purpose authorized under the FCRA. iQ Intel describes commercial entities and uses publicly available data sources; it does not access consumer credit data.

10. Data and Privacy

Your use of iQ Intel is also governed by our Privacy Policy, which describes how we collect, use, and protect your information and how upstream TenantIQ research is de-identified and aggregated before reaching iQ Intel products. Enterprise customers who require a Data Processing Addendum may request one by contacting jonathan@crelytic.ai.

11. Intellectual Property and Customer Use License

Platform IP. All content, features, and functionality of iQ Intel — including text, graphics, logos, trademarks, software, source code, user interface, benchmark methodology, scoring algorithms, aggregation pipelines, and documentation — are the exclusive property of CRELYTIC and are protected by applicable intellectual property laws.

Derivative data ownership. All aggregated, de-identified commercial-entity data, scores, benchmarks, and analytics produced through iQ Intel are and remain the exclusive property of CRELYTIC. Access granted to subscribers under this Section does not transfer ownership of the underlying data.

Customer Use License. In exchange for your subscription fees, CRELYTIC grants your organization a non-exclusive, non-transferable, non- sublicensable license to use iQ Intel outputs (including TRI publications, Market Demand digests, drift alerts, and API responses) for (a) internal business decision-making, and (b) limited sharing with direct business counterparties in connection with a specific prospective commercial lease or similar transaction, provided that any such sharing preserves CRELYTIC attribution and does not re-expose the output to the public. You may not resell, redistribute, syndicate, publicly publish, incorporate into a competing product, or use iQ Intel outputs to train competing models without CRELYTIC's prior written consent.

Relationship to TenantIQ. iQ Intel derivative products are built on research output originally produced through the TenantIQ platform under the terms described in Sections 5, 6, and 11 of the TenantIQ Terms of Service. This Section 11 survives termination of these Terms and of your subscription.

12. Termination

Either party may terminate the account at any time. You may cancel your account through account settings or by contacting us. Upon termination, your right to access the Service ceases at the end of the current paid billing period. CRELYTIC may retain customer-facing account data for up to 90 days following termination for administrative purposes, after which it will be deleted in accordance with the Privacy Policy. Derivative intelligence data owned by CRELYTIC under Section 11 survives termination and is not deleted. CRELYTIC may suspend or terminate accounts that violate these Terms without prior notice.

13. Changes to Terms

CRELYTIC may modify these Terms at any time. Notice of material changes will be provided by posting the updated Terms on this page with an updated "Last updated" date and, where appropriate, by email to the address associated with your account. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

14. Governing Law

These Terms are governed by the laws of the State of Florida, United States, without regard to its conflict-of-laws rules. The parties submit to the exclusive jurisdiction of the state and federal courts located in Florida for the resolution of any dispute arising out of or relating to these Terms or the Service, except that either party may seek injunctive relief in any court of competent jurisdiction.
